The Civil Rights Act of 1875
The Civil Rights Act of 1875, also known as the Sumner Civil Rights Bill, was a law that aimed to protect African Americans from discrimination in public accommodations and transportation.
The bill prohibited discrimination in public accommodations: hotels, theaters, transportation, and other places of public amusement, guaranteed equal access to public transportation and prohibited the exclusion of African Americans from jury duty.
The bill, drafted by Senator Charles Sumner of Massachusetts in 1870, passed Congress in 1875. However, in 1883 the Supreme Court ruled the bill unconstitutional citing the 14th Amendment to the Constitution granted Congress the right to regulate states, not individuals. This decision led to the establishment of separate-but-equal policies and second-class citizenship for African Americans.
The principle of protecting public accommodation rights through federal legislation was revived via the Civil Rights Act of 1964. Provisions of this civil rights act forbade discrimination on the basis of sex, as well as, race in hiring, promoting, and firing and was signed into law by President Lyndon B. Johnson later that year.
