| SUBJECT MATTER: |
| Receive, consider and act upon a Construction Access Agreement for The Woodlands Waterway with The Waterway Landing Homeowners Association (C-2024-0665); |
| FISCAL IMPACT: |
| The Waterway Landing Homeowners Association ("HOA") will pay an access fee of $1,500 to cover the cost of drafting of the agreement and for the exclusive use of the area while maintenance functions are being performed. |
| BACKGROUND: |
| The HOA is requesting a pathway use/access agreement for the pathway on the south side of The Woodlands Waterway while performing maintenance work. The maintenance work will require the use of certain equipment/machinery, such as a boom lift, to access the property and facilitate timely and efficient completion of the work. Upon approval by the Township, the HOA will be permitted to temporarily close portions of the pathway for a short period of time only between 8:00 a.m. and 5:30 p.m., Monday through Friday, in order to protect persons and property. The term of the agreement is for five years. Similar agreements for pathway use/access have been approved over the years. Township legal counsel has reviewed the attached draft pathway use/access agreement. Various times and dates in the draft agreement will need to be updated but are provided to demonstrate the impact requested. |
| RECOMMENDATION: |
| Authorize the President/Chief Executive Officer to execute the Construction Access Agreement for The Woodlands Waterway with The Waterway Landing Homeowners Association as approved to final form by Township legal counsel. |
