OLYMPIA… The state Senate has unanimously passed legislation from Sen. Keith Goehner that is intended to streamline the planning of energy projects.
Goehner’s bill would ensure that when a city or county collaborates with the state’s Energy Facility Site Evaluation Council (EFSEC) for technical assistance, application reviews, or facility inspections, it is automatically considered compliant with all relevant state and local laws.
“This would simplify the regulatory process and clarify the legal standing of local governments engaging with EFSEC,” Goehner said. “It is a step forward in giving local government more control, tools and opportunities when planning energy projects.”
Senate Bill 5317, passed Friday, also would provide exemptions for local governments when providing certain services for projects under the jurisdiction of the EFSEC.
“A lot of times, local governments are discouraged from entering into projects with the EFSEC because its regulations are inconsistent with local codes and development regulations. This proposed policy change would prevent cities and counties from feeling they are putting themselves at risk for appeals and claims for damages.”
The bill has been referred to the House Environment and Energy Committee for further consideration.
