    Lot of 104 4 in 3-ring binders. In good condition.

    The use, disposition, export and re-export of this property are subject to all applicable U.S. laws and regulations, including the Atomic Energy Act of 1954, as amended; the Arms Export Control Act (22 U.S.C. 2751 et seq.); the Export Administration Act of 1979 as continued under the International Emergency Economic Powers Act (Title II of Pub. L. 95-223, 91 Stat. 1626, October 28, 1977); Trading with the Enemy Act (50 U.S.C. 4305) as amended by the Foreign Assistance Act of 1961); Assistance to Foreign Atomic Energy Activities (10 CFR part 810); Export and Import of Nuclear Equipment and Material (10 CFR part 110); International Traffic in Arms Regulations (22 CFR parts 120 et seq.); Export Administration Regulations (15 CFR part 730 et seq.);.); and the Espionage Act (37 U.S.C. 791 et seq.) which among other things, prohibit:

    a. The making of false statements and concealment of any material information regarding the use or disposition, export or re-export of the property; and

    b. Any use or disposition, export or re-export of the property which is not authorized in accordance with the provisions of this agreement.

    DEFINITIONS:

    The following definitions apply internally to this Property Transfer Authorization:

    1. Transferor means the entity listed in block 5, Transfer From.

    2. Transferee means the entity listed in block 6, Transfer To.

    NO WARRANTIES: Transferor, including its officers, employees, agents and subcontractors, make no representations whatsoever, extend no warranties of any kind, either express or implied, including but not limited to the implied warranties of merchantability or fitness for a particular purpose, and assumes no responsibilities whatsoever with respect to design, development, manufacture, or use of the transferred items. Furthermore, in no event shall the Transferor be liable for direct, indirect, special consequential, incidental or punitive loss, damage or expenses arising out of or in connection with this property transfer authorization or use of the items listed herein.

    WAIVER OF LIABILITY: By accepting this equipment, Transferee and its representatives do hereby release, waive, discharge Transferor, its employees, officials, officers, agents, and all levels of subcontractors from liability from any and all claims resulting in personal injury, accidents or illnesses and property damage or loss which might arise either directly or indirectly from the use of transferred items in this Property Transfer Authorization.

    The Transferee assumes all risk of injury or harm arising from the use of transferred items and agrees to release, indemnify, defend, and forever discharge the transferor from all liability, claims, demands, damages, costs, expenses, and causes of action due to death, injury, loss, or damage to the Transferor.  

    INDEMNIFICATION: Transferee agrees to indemnify and hold harmless the Transferor, its employees, officials, officers, agents and all levels of subcontractors from any and all claims, liability and damages, arising from the use of the transferred items.

    Deficiencies when known, have been indicated in the item description. The absence of any known deficiencies does not mean that none exists. Potential Bidders are urged to inspect this property prior to placing a bid. Requests for extensions on removal can only be granted by the Contracting Officer of the sale (tonyar.dillard@gsa.gov) in writing. The custodian does not have the authority to grant such requests. Repairs may be required.
